Abstract

Herkömmliche Kommunikation unterliegt zahlreichen staatlichen Vorschriften. Straf- und Juggendschutzrecht, Urheberrecht, Datenschutzrecht, Wettbewerbsrecht und Medienrecht regeln Kommunikation und bestimmen - manchmal nur mittelbar - ihre Inhalte. Diese Arbeit zeigt, daß solche Regeln im Bezug auf das Internet und andere Formen digitaler Kommunikation an Grenzen stoßen: Sie sind auf die neuen Kommunikationsformen nicht anwendbar oder können in ihnen nicht wirksam durchgesetzt werden. Bei der Regulierung digitaler Medien wird der Staat die Rolle wechseln müssen. Statt wie bisher Inhalte und Umstände von Kommunikation vorzugeben oder zu verbieten, sollte er Eigenverantwortung und Selbstkontrolle fördern. Dazu möchte das Buch Anstöße geben
