Abstract

In der Dokumentationspraxis gibt es noch Unsicherheiten über die rechtliche Situation der Abstract-Erstellung. Zum einen betrifft dies die Frage, in welchem Maße Abstracts von Dritten für eigene Zwecke übernommen werden dürfen, d.h. inwieweit von Originalarbeiten eigene Abstracts erstellt werden müssen. Zum anderen braucht der Abstract-Autor selbst einen rechtlichen Schutz seiner persönlichen intellektuellen und ökonomischen Leistung, die sich im Abstract widerspiegelt. Solche Fragen werden in diesem beitrag erörtert, wobei das Hauptinteresse den Regelungen zum Urheberrecht gilt. Auf Grund ihrer Bedeutung werden das Wettbewerbs- und Vertragsgesetz ebenso behandelt wie die geplante EU-Richtlinie für den Schutz von Datenbanken
