Abstract

Im Verhältnis der Bibliotheken zu den Verlagen sind vornehmlich zwei Regelungen des so genannten »Zweiten Korbs« zum UrhG von Bedeutung: die neuen Schrankenregelungen zur on-the-spot consultation (§ 5212) sowie zum Dokumentenversand (§ 53a). Beide Schranken mindern die Auswertungschancen der Verlage nicht unerheblich, sind aber in der nach langem Ringen gefundenen Kompromisslösung einigermaßen ausgewogen in der Berücksichtigung der Interessen von Rechteinhabern und Nutzern. Entscheidend wird allerdings sein, ob angemessene Vergütungssätze zum Tragen kommen. Die Erfahrungen bei § 52a, für den auch nach fünf Jahren noch kein Cent an die Rechteinhaber geflossen sind und es immer noch an einer flächendeckenden Erhebung der tatsächlichen Nutzungen fehlt, stimmen sehr pessimistisch.
