Abstract
Die Autorin ist Bibliothekarin und Juristin. Seit 1992 als Bibliotheksdirektorin in Berlin tätig, vertritt sie in Rechtsangelegenheiten das deutsche Bibliothekswesen. Das vorliegende Buch ist der unveränderte Abdruck ihrer Dissertation. Sie hat zum einen den vollständigen Abriss elektronischer Bibliotheksangebote und ihrer rechtlichen Würdigung, als auch die Notwendigkeit von gesetzlichen Ausnahmetatbeständen im digitalen Umwelt zum Gegenstand. Am Vorabend der Gesetzesnovelle zum Urheberrecht in der Informationsgesellschaft behandelt die Autorin den Interessenkonflikt zwischen Rechteinhabern und Bibliotheken, der bisher mit jeder neuen technischen Entwicklung aufs neue entbrannte, mit dem Ergebnis, dass Ausnahmetatbestände aus dem geltenden Recht nicht abgeschafft, sondern bei Netzwiedergaben neu definiert werden müssen. Diese werden von der Autorin durch konkrete Formulierungsvorschläge - gestützt auf den international geltenden Grundsatz der Berner Übereinkunft - für den deutschen Gesetzgeber aufbereitet. Sie alle dienen dem Ziel, Bibliotheken auch künftig in die Lage zu versetzen, ihrem demokratischen Auftrag der Vermittlung und Bewahrung von Information unabhängig von dem Träger, auf dem sie sich befinden, Rechnung zu tragen und dabei eine Balance der Interessen wieder herzustellen.
